Terms & Conditions of Repair & Service
PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF REPAIR AND SERVICE CAREFULLY. The following are Terms and Conditions of Repair and Service between A Biomedical Service INC. and all Buyers, Service Clients, and Lessors of Goods and Services.
All parts sold by A Biomedical Service INC. are either OEM or Aftermarket.
A Biomedical Service INC. complies with all applicable provisions of the Health Insurance Portability and Accountability Act of 1996 (HIPAA).

Terms and Conditions
During the course of repairing or servicing certain types of medical equipment, A Biomedical Service INC. may need to change or replace parts. A Biomedical Service INC. will use OEM parts wherever possible and if requested by customer, otherwise aftermarket parts meeting A Biomedical Service INC.’s quality control standards will be used. Some original equipment manufacturers may not accept repair of certain equipment if any parts or internal components have been altered or replaced. This may include upgrading the equipment in the event of a recall by the OEM. A Biomedical Service INC. will support published recalls by the OEM to the best of our ability and where parts and software are available to perform the necessary updates.
Repair
SERVICE
A Biomedical Service INC. will service select medical equipment and devices for the flat-rate charge as stated on the rental or repair agreement. If service is needed that requires labor or parts not covered by the flat-rate service charges in your rental or repair agreement, A Biomedical Service INC. will ask for customer’s written approval of estimate. If you do not agree to the parts and labor charges that A Biomedical Service INC. has recommended, A Biomedical Service INC. will return your product to you and may charge a diagnostic fee, applicable sales tax, and shipping costs. Unless specifically directed in servicing your product, A Biomedical Service INC. reserves the right to use new, used, or refurbished parts or products. A Biomedical Service INC. may also exchange the product with a new, used, or refurbished product at our sole discretion.
SERVICE EXCLUSIONS
The flat-rate repair service does not cover cosmetic damage, damage due to accident, negligence, abuse, misuse, unauthorized modification or repairs, extreme environmental conditions, extreme physical or electrical stress or interference, fluctuation or surges of electrical power, lightning, static electricity, fire, acts of God or other external causes. A Biomedical Service INC. reserves the right to refuse service for such damage. In such an event, A Biomedical Service INC. may return the product to you without servicing it and may charge you a diagnostic fee, applicable tax, and shipping fees.
Service and Repair Warranty
In servicing equipment, A Biomedical Service INC. warrants (1) that service will be performed in a workmanlike manner by qualified technicians; and that (2) all parts or products used in the serrvice shall be free from defects in materials and workmanship for the warranty period as specified in your Sale or Lease agreement; and (3) that the entire repaired or replaced product will be free from defects in materials and workmanship during the warranty period (as specified in your Sale , Lease, or Repair agreement) from the date of service.
This warranty is an express limited warranty. If non-conforming service is provided, or a defect is found in the repaired or replaced product during the warranty period, or a new defect arises in a replacement part or product during the warranty period or repair assurance period, at its discretion, A Biomedical Service INC. will (1) repair the part or product, using new, used or refurbished replacement parts, or (2) replace the part or product with a new, used, or refurbished equivalent part or product, or (3) refund the sum paid to A Biomedical Service INC. for the service.
Upon receipt of supplied or repaired items from A Biomedical Service INC., customer agrees to inspect and test the items supplied and/or repaired by A Biomedical Service INC. prior to putting equipment into use.
For “Out of Box Failures”: Upon receipt of supplied and/or repaired medical parts or equipment from A Biomedical Service INC., customer agrees to inspect and test the items supplied and/or repaired by A Biomedical Service INC. within three (3) business days to determine if an “out of the box” failure exists. Customer agrees to report these failures within the warranty period. Any out of the box failure claims made outside the warranty period will be considered a new repair and will be subject to normal service and repair fees.
Service & Repair Warranty Exclusions
This warranty does not cover problems arising from:
- Water damage, physical damage, neglect, improper use, or incorrect installation of products.
- External causes such as accident, misuse, issues with electrical power supply, or abuse.
- Service or repair not authorized by A Biomedical Service INC.
- Devices that have broken A Biomedical Service INC. warranty seals.
- Failure to follow product instructions, resulting in damage to product.
- Usage not in accordance with OEM recommendations for that product’s use.
- Problems caused by use of accessories, parts, or components not supplied to customer by A Biomedical Service INC.
- Items with missing or altered A Biomedical Service INC. service tags.
- Items with missing or damaged serial numbers.
- Any product for which A Biomedical Service INC. has not received payment.
